Domain Name Registration Terms & Conditions
 
This agreement represents the complete agreement and understanding between 123hosting.com Inc., (hereinafter called 123hosting.com) and the customer and supersedes any other written or oral agreement. Upon notice published on-line via 123hosting.com, 123hosting.com may modify these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change the services offered.
1. Uniform Dispute Resolution Policy (UDRP).

As a Registration Service Provider, 123hosting.com follows The Uniform Dispute Resolution Policy for domain-name disputes. Under the policy, most types of trademark-based domain-name disputes must be resolved by agreement, court action, or arbitration before a registrar will cancel, suspend, or transfer a domain name. Disputes alleged to arise from abusive registrations of domain names (for example, cybersquatting) may be addressed by expedited administrative proceedings that the holder of trademark rights initiates by filing a complaint with an approved dispute-resolution service provider.
2. Service.

123hosting.com's role in the registration of domain names is limited to
Registration Service Provider ("registrar").
3. Fees and Payments.

Registrant agrees to pay the appropriate fee as displayed at http://www.domain-registry.com / http://www.123hosting.com (and varies depending on the type of domain name requested). The payment has to be made before the application can be submitted for registration.

The non-refundable fee covers the cost of submitting a domain name to the appropriate registrar. Please note that each registrar has it's own terms and conditions for accepting/approving a domain name registration. 123hosting.com's fee is nonrefundable even if the domain name is rejected (because the fee is for the service of submitting the application). Each registrar might have a additional domain registration fee (ex. Internic charges $70 for the first 2 years of registration).
4. Accuracy of information provided.

123hosting.com will submit application to the appropriate registrar as provided. It is the registrants responsibility to provide accurate information. Any change to the original information has to made directly to the registrar and not to 123hosting.com
5. Agents.

Registrant agrees that if this Registration Agreement is completed by an agent for the Registrant (sometimes called Administrative Contact), the Registrant is nonetheless bound as a principal by all terms and conditions herein.
6. Limitation of Liability.

Registrant agrees that 123hosting.com will not be liable for any loss of or use of Registrant domain name, or for interruption of business, or any indirect, special, incidental, or consequential damages or any kind (including lost profits) regardless of the form of action whether in contract, tort (including negligence), or otherwise. Registrant agrees that in no event shall the maximum liability of 123hosting.com under this Agreement for any matter exceed One Hundred Dollars ($100).
7. Indemnity.

Registrant agrees, in the event of a dispute arising with any third party, to indemnify and hold 123hosting.com harmless.
8. Breach.

Registrant agrees that failure to abide by any provision of this Registration Agreement may be considered by 123hosting.com to be a material breach.
9. No Guaranty.

Registrant agrees that, by registration of a domain name, such registration does not confer immunity from objection to either the registration or use of the domain name.
10. Warranty.

Registrant warrants by submitting this Registration Agreement that, to the best of Registrant's knowledge and belief, the information submitted herein is true and correct, and that any future changes to this information will be provided to the appropriate registrar on a timely manner.
11. The New GTLD's.

123hosting.com takes advance "booking" for the new proposed GTLDs. The charge is a nonrefundable $19.95/domain submitted. This fee is nonrefundable and doesn't guarantee the acceptance of the domain name. There is no guarantee of when these domain names will be available (if at all).
12. Right of Refusal.

123hosting.com, in its sole discretion, reserves the right to refuse service of domain submission.
13. Severability.

Registrant agrees that the terms of this Registration Agreement are severable. If any term or provision is declared invalid, it shall not affect the remaining terms or provisions which shall continue to be binding.
14. Entirety.

Registrant agrees that this Registration Agreement is the complete and exclusive agreement between Registrant and 123hosting.com regarding the registration of Registrant's domain name. This Registration Agreement supersede all prior agreements and understandings, whether established by custom, practice, policy, or precedent.
15. Governing Law.

Registrant agrees that this Registration Agreement shall be governed in all respects by and construed in accordance with the laws of the province of Ontario, Canada.
16. Domain Name Registration Agreement.

By submitting a request for a domain name registration the Registrant agrees that he/she has read and agrees to be bound this Registration Agreement.
